P3 COPYRIGHT

QUESTION 1 - PROPS

-There might be copyright on the cover of the book.

- Depends whether you can see what’s written.

- How is the book being used?

If it’s just used as a prop then its incidental. If they are discussing it then it is an infringement of copyright.

- How long is it on screen for?
I will avoid having this issue in my film by making sure there is nothing visible in the background of the set that could have copyright issues like this around it. If there is something that I don't notice then I will make sure that the characters don't mention it and there isn't too much attention drawn to it.

QUESTION 2 – ADAPTATONS

-If you have consent of the author it’s fine?

-Depends how much it’s based on the short story.

-Depends if the short story has copyright or not.
I am not adapting my story from another one so this issue is not relevant to my film.
QUESTION 3 - DISPUTES

-Buy the films writes so that you own the film and you don’t.

-Discuss it with them.

-See if they don’t mind as long as you credit them.

-Do it anyway because you both have equal rights.
I am working by myself to create this film so this issue is unlikely to occur. However if there was a dispute between myself and an actor or someone else who will be helping me to make the film then I would resolve this before we agree to anything by talking about what would happen if we fell out. For example, we would agree to sharing the rights no matter what happens.

QUESTION 4 – USING TV OR FILM CLIPS

-Depends how long the clip is.

-Depends how you using it.

-Depends if the clip has copyright or not.
I will resolve this issue by not having anyone else's work in my film at all. I will just create it all myself.

QUESTION 5 – TV PROGRAMS ON TV SCREEN

-Depends how long it’s on for.

-Depends how old the footage is.

-How clearly can you hear and see it.

-Depends if the character mentions it.
In my film there won't be any screens where this will be an issue because the majority of it will be outside. However if this issue did occur then I would make sure that there was no attention on the TV screen.

QUESTION 6 – REPRESENTING PEOPLE (DEFERMATION)

-How much is said about the quote?

-Doesn’t matter because of freedom of speech.

-Depends how offensive it is.
QUESTION 7 – USING MUSIC SAMPLES

-Depends if the samples have copyright.

-You could get permission of the person who owns them.

-How well are they heard in the music? Is the whole song made up of samples?


QUESTION 8 – PERFORMING COPYRIGHTED SONGS

-Depends how much of the song is sung.

-If it’s changed slightly.

-If it’s sung well or just making a joke.
QUESTION 9 – MUSIC VIDEO’S

-Depends if the song is copyrighted.

-The record company might not own the rights if they have hired another company to make the music video.


QUESTION 10 – PUTTING FUNDED MEDIA ONLINE

-Depends on what you agreed the conditions of them funding you were.


QUESTION 11- NAMES

-If it is a big company making feature films then they will have copyrighted the name.

-The company might complain if you put something online with their name in case people think it’s made by them.

-They also might not be happy in case people think that their film was made by you.


I could resolve this my calling my company something personal like my name because no one else will have this.
QUESTION 12 – CONSENT FOR PERFORMERS UNDER 16

-Not if the parents have given written permission because they are in charge of what happens so if they give permission then there is no problem.

-Depends where the film will be displayed.

-If they are getting paid or missing school then yes.
To resolve this I will get written permission from all of the parents of any under 16 year olds in the film. I will probably do this my creating a form for them to fill out. I won't need a licence because the children wont be missing school and there not getting paid.
QUESTION 13 – CAN DOCUMENTRYS BE SUED FOR MAKING PEOPLE LOOK BAD

-Not if the people got the correct permissions to have the people in the documentary.
